Terms and Conditions

Changes

Sitges Silver Service S.L will be exempt from responsibility due to “force majeur” or facts that neither the company nor its suppliers have been able to avoid equally when the cause is attributable to the client or a third person. Equally any changes made to activities caused by local political conditions, strikes, acts of God, delays, unprecedented traffic, road blocks and re-routing, mechanical breakdown, weather, sickness or other unforeseeable circumstances Sitges Silver Service S.L will not be held liable for any losses incurred as a result thereof. Sitges Silver Service reserves the right to substitute locations and venues of a similar quality. Furthermore Sitges Silver Service reserves the right to change the terms of these conditions from time to time without reference to customers.

Availability

Where Sitges Silver Service works in conjunction with suppliers, all activities and services offered are subject to availability at the time of booking and will only be confirmed 100% once payment in full has been received.  If applicable, prices will not be confirmed until final numbers of participants and location, have been confirmed, start and finish  time communicated, as well as availability of permits confirmed and final technical requirements sourced. Some adventure activities can only be confirmed the morning of the activity as they may be weather dependent and suppliers may cancel due to unforeseen reasons. Sitges Silver Service will not be held liable for lack of availability due to a change by supplier and every attempt will be made to substitute the product or service, reschedule or find an alternative location for the same activity or replace the activity / event for another.

The Weather

Many Sitges Silver Service S.L events and experiences are dependent on the weather and will be confirmed the morning of the activity. If the activity you booked is cancelled due to the weather you will be able to reschedule for another day, however, the activity remains subject to weather conditions. In the event that you are leaving the following day you will receive a 100% refund, however proof of departure date will be required.

Activity Session Lengths and variations to publicity material

The duration of activities as specified on our website and brochure are approximate and may vary at any time. Sitges Silver Service will keep you fully informed of any changes to timing and sessions length and will do everything in its power to follow the scheduled itinerary. Equally the vehicles, crafts and locations for each activity may vary slightly as per what appears on our website and brochure.

Transport

Sitges Silver Service S.L will be responsible for the pick up of clients at an agreed meeting point. Sitges Silver Service accepts no responsibility for a participant’s failure or late showing for any activity and a strict no refund policy applies in the event of this happening.

Activity Limitations and Restrictions

At the time of booking an activity Sitges Silver Service S.L. will confirm if the activity chosen is subject to requirements; including age, health or weight etc. In the event that you proceed to book without meeting the requirements, you will be liable for all charges.

Technical, Mechanical Failure or Incapacitation of Monitor

While every effort has been made to ensure venues, equipment, vessels and crafts are in 100% working order for all activities, we reserve the right to make reasonable substitutions on the day in light of any possible mechanical breakdown or incapacitation of the activity monitor.  In the unlikely event that the activity is cancelled at short notice, due to the above mentioned issues, participants shall be offered as compensation, a refund or an alternative date or an event of at least the same value.

Insurance Protection

Sitges Silver Service is in possession of current Public Liability insurance for its activities and events.  Outdoor activities, Adventure Sports suppliers and Venues have all risk insurance and may ask you to sign a disclaimer before participating in an event. We have taken all necessary precautions to vet our suppliers ensuring they provide the highest of standards of safety, however, Sitges Silver Service S.L cannot provide any guarantee of the suppliers safety or performance standards. In some cases suppliers may reserve the right to deem a person unfit for the activity and in this case, their decision and judgement is final. In the event of any of the above you may wish to top up your insurance for additional coverage. Sitges Silver Service S.L does not accept any responsibility for insurance issues.

Behaviour

We expect our customer's conduct to be of a good standard and Sitges Silver Service S.L or the activity supplier reserves the right to end a customer’s participation if their conduct is deemed disruptive to the activity and to the other participants. In these situations, we accept no responsibility for losses incurred.

Refunds and Cancellations

No refunds are made for any unused services including accommodation, excursions, transport, adventure activities, or any other service offered by Sitges Silver Service beyond the cancellation penalties as stated in the Payment Information form under the Booking section of our website. In case of your cancelling any portion of the activities contracted with Sitges Silver Service there are no refunds for pre-booked activities or any other service or cost.

Customer Complaints

All complaints of any nature should be brought to the attention of Sitges Silver Service on the same day they take place in order to attempt to rectify the problem or complaint. We will thoroughly investigate all problems or complaints made by you, however, it will facilitate the situation and possibly assist in achieving an amicable outcome or solution if you inform Sitges Silver Service on the day - rather than after the fact. Furthermore, Sitges Silver Service S.L´s liability shall be limited only to the cost of the sale price of the experience.

Extent of liability

Sitges Silver Service S.L liability for any claim or breach of obligation regarding any single voucher or activity shall not exceed the price of that activity. This excludes claims arising from personal injury or death due to the negligence of Sitges Silver Service or any of our staff for whom we are responsible. Since Sitges Silver Service acts as an agent on occasions all services contacted through third parties are subject to the terms and conditions under which such services are offered or provided.

Jurisdiction

Sitges Silver Service S.L is a company registered in Spain and as such any disputes arising from these terms and conditions shall be dealt with in the Barcelona courts.

Acknowledgment of Terms and Conditions

Your participation shall be constituted as acceptance of these terms and conditions. If you do not agree with these terms and conditions once a purchase has been made, Sitges Silver Service S.L will not be liable for any refunds.
